The jury found that Amber Heard had defamed Johnny Depp in his December 2018 publication, The Washington Post. The Washington Post included an editorial note from Johnny Depp at the beginning of Amber Heard's article about surviving domestic violence after sentencing in the case, finding the article defamatory.
On Wednesday, the jury returned its verdict, unanimously ruling that Hurd, 36, slandered her ex-husband Depp, 58, three times in a December 2018 post; Depp's name was not mentioned in the article. The jury awarded Depp $15 million in damages, but the judge reduced it to $10.35 million under Virginia state statutes. Hurd, who received $2 million in the defamation suit, plans to appeal the ruling.
On Thursday, the digital version of Hurd's publication was accompanied by an editorial: "2019 Johnny Depp sued Amber Hurd for defamation based on this 2018 publication. The jury noted that Depp, through his attorney Adam Waldman, had slandered Hurd on one of three counts in his counter-question.
Legal analyst Emily D. Baker told news that she thought it was a "smart move" for the Washington Post to add a note to the editor rather than removing the article entirely from the site: "Since this case is being watched and commented on as such, I think op.-ed still needed for context. So I appreciate that you posted a notice instead of downloading a comment. And I understand that they include statements that turn out to be defamatory.
"It would have been easier to take it off and say nothing. But I appreciate those who say, 'Everyone reading this is happening,' Baker added.The Washington Post counted an editor's note
